A Single Mom Learns the "Why" to her Probate Question

Q: I'm a 37 year old single mom with two children; their father is not in the picture. I make Ok money and own my home. I often worry about what will happen to my kids, should the worst happen to me while they're still minors. It honestly has me losing sleep, but I'm not sure what to do - or if I can even afford it. I'm also worried that I don't have all the documentation needed to even put a will or estate plan into place. I feel paralyzed and overwhelmed!

First, go easy on yourself. You're managing a lot - all on your own! I'm a parent, too, so I completely understand your concerns. Without a plan, you're right to worry about your kids' future without you; if something happens to you, you don't want a judge having the final say about who raises your children and how your assets are distributed to your kids when they turn 18. What you need is an Estate Plan; the main document within, your Trust, will define the "how and when" regarding your children's inheritance and your Will will dictate guardianship.
