What to Consider when Including Pets in an Estate Plan
During probate, pets are treated as personal property. However, pets are much more than just property. For many people, pets play the same role as lifelong companions and children.
Here are some practical considerations for including pets into an estate plan:
• Identify a willing and able caretaker who can take immediate custody during an emergency or upon death. The caretaker can be named in a will and specific instructions left for their care.
• Set aside financial resources for the care of the pet. This can be done through direct bequests, beneficiary designations, or by including a pet trust as part of the estate plan.
• Consider including pet trust provisions in your trust. California allows someone to set aside funds for the benefit of a pet. The provisions can provide details about the care that is to be provided. Sufficient funds must be set aside for the anticipated life of the pet and their food, veterinary, grooming and other needs.
By including pets as part of an estate plan, you can be comfortable knowing that they will receive the care and support needed for their lifetime no matter what happens.
