Legal Documents for A College-Bound Young Adult
You've done everything you can to raise your child right. Now they're 18 and going off to college. But in the eyes of the law, they are the same as strangers. You no longer have any right to access their financial or medical records or to make decisions for them, even when they are injured. There are four documents to consider having your child sign before sending them to college.
General Power of Attorney A general power of attorney (POA) allows the appointed person to handle the child's financial matters, such as banking, tuition, student loans and other issues the child may encounter.
Advanced Healthcare Directive An Advanced Healthcare Directive (AHCD) allows the appointed person to make medical decisions when your child cannot make it for themselves.
HIPAA Authorization This allows for the release of private medical information to the authorized recipients. This can include detailed medical reports or just information on scheduled appointments.
FERPA Release Form The Family Educational Rights and Privacy Act (FERPA) provides a way for adult children to consent to having their educational records accessed by a parent.
Without a full set of these documents, a parent may find themselves unable to help their child when problems inevitably arise. Getting these documents signed before they head out to college is the best way to continue to assist them so they can focus on their continuing education.
