Timing Matters When Updating your Estate Plan
Estate planning is an ongoing process. As our lives evolve, so should the legal documents that protect our family and property. Keeping your estate plan up-to-date is critical to make sure it functions as intended.
Without an updated estate plan, the plan can contain all sorts of hidden errors, such as naming individuals who are deceased as beneficiaries, incorrectly titling property or naming fiduciaries who are no longer willing or able to serve.
Certain life events can impact your estate plan. You should consult your estate planning attorney right away if any of these events occur:
Marriage, divorce, or remarriage of you or any of your primary beneficiaries
Birth or adoption of a child or grandchild
Death or incapacity of a spouse, beneficiary or someone to act as trustee or executor
Significant changes in finances, such as buying or selling property, receiving an inheritance or starting a business
Changes in laws impacting you and your family
Relocation to a different state
Diagnosis of a serious medical condition or needing long-term care
Minor children who have grown into mature, responsible adults who can now be put in charge of your affairs
Even without any major life events, it is wise to review your estate plan with your attorney on a regular basis. The industry standard is every three to five years. An attorney can help identify and correct minor problems before they become big ones.
